By accessing or using Viridian's virtual try-on service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Description of Service

Viridian provides an AI-powered virtual try-on service that allows users to upload photos and generate images and videos showing how clothing and garments might appear when worn. The Service is provided on a credit-based system.

User Accounts

To use our Service, you must create an account through one of our supported third-party authentication providers (Google, Apple, GitHub, or Microsoft). You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Providing accurate and complete information
• Promptly updating your account information as needed

Credits and Payments

Credit System

Our Service operates on a pay-as-you-go credit system. Credits are consumed as follows:

• Image generation: 1 credit per image
• Video generation: 7 credits per video

Credit Packages

We offer the following credit packages:

• Starter Pack: 45 credits for $9.99
• Creator Pack: 150 credits for $29
• Pro Pack: 260 credits for $49

Complimentary Generations

After your first credit purchase, you will receive complimentary generations (3 images and 1 video) which will be used before your purchased credits.

Payment Processing

All payments are processed by Paddle, our third-party payment processor. By making a purchase, you agree to Paddle's terms and conditions. We do not store your payment information.

Refunds

Credits are generally non-refundable once purchased. Refunds may be provided at our sole discretion within 30 days of purchase for unused credits, subject to our refund policy. Generated content and consumed credits are not eligible for refund.

User Conduct and Responsibilities

You agree to use our Service lawfully and responsibly. You must not:

• Upload content that violates any laws or regulations
• Upload content that infringes on others' intellectual property rights
• Upload inappropriate, offensive, or harmful content
• Use the Service to create misleading or deceptive content
• Attempt to reverse engineer or interfere with the Service
• Share your account with others
• Use the Service for commercial purposes without authorization

Intellectual Property

Your Content

You retain ownership of the photos and images you upload to our Service. By uploading content, you grant us a limited license to use, process, and store your content solely for the purpose of providing our Service.

Our Service

Viridian owns all rights to the Service, including our technology, software, algorithms, and platform. Our Service is protected by intellectual property laws.

Generated Content

Generated images and videos are automatically deleted after 30 days for privacy and storage management purposes. You are responsible for downloading any content you wish to keep beyond this period.

You may use generated content for personal, non-commercial purposes. Commercial use of generated content may require additional licensing or permissions.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your information. By using our Service, you consent to our data practices as described in our Privacy Policy.

Service Availability

We strive to provide reliable service, but we do not guarantee that our Service will be available at all times or free from interruptions. We may modify, suspend, or discontinue the Service at any time with or without notice.

Termination

You may terminate your account at any time. We may suspend or terminate your account if you violate these Terms or for other reasons at our discretion.

Upon termination, your access to the Service will cease, and any remaining credits will be forfeited. Generated content will be deleted according to our retention policy.

Disclaimers

Our Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• The accuracy or quality of generated content
• That the Service will meet your specific requirements
• That the Service will be uninterrupted or error-free
• That defects will be corrected

Limitation of Liability

To the maximum extent permitted by law, Viridian shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless Viridian from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration or in the appropriate courts.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
